Mit großer Bestürzung sehen wir den unfassbaren Verlust an Menschenleben, die hohe Zahl an Verletzten und die Schäden an Kulturstätten infolge der Erdbeben in der Türkei und in Syrien. Als Nationalkomitee in Deutschland mit einer hohen Anzahl türkeistämmiger und syrischer Mitbürger:innen, Kolleg:innen und Freund:innen stellen wir fest, dass die Auswirkungen der Erdbebenkatastrophe unmittelbar mit unserem Land verflochten sind.

Wir sprechen allen Betroffenen unser Mitgefühl aus und versichern unserer Solidarität. Wir rufen alle Museumskolleg:innen innerhalb und außerhalb unseres Verbandes dazu auf, die betroffenen Kolleg:innen und Freund:innen in dieser schwierigen Situation nicht alleine zu lassen.

Als Organisation, die sich für den Schutz und die Bewahrung des kulturellen Erbes einsetzt, sind wir zutiefst betrübt über die Beschädigung mehrerer Kulturstätten, darunter der Zitadelle von Aleppo in Syrien und der Zitadelle von Gaziantep in der Türkei. Wir wissen um deren Bedeutung als wesentliche Bestandteile der kulturellen Identität und des sozialen Gefüges der betroffenen Gemeinschaften. Unser Mitgefühl gilt insbesondere den Gemeinden, in denen wichtige Stätten und die reiche Kulturgeschichte, die sie repräsentieren, beschädigt wurden.

ICOM Deutschland weiß, wie wichtig der Schutz des kulturellen Erbes in Krisenzeiten ist, und wir unterstützen die Bemühungen um den Schutz und die Wiederherstellung der beschädigten Stätten in beiden Ländern. Angesichts der Herausforderungen fordern wir internationale Organisationen und Regierungen auf, sich zusammenzuschließen und die notwendige Unterstützung zu leisten, um die langfristige Erhaltung und Reparatur des kulturellen Erbes in den betroffenen Regionen zu ermöglichen.

ICOM Germany and the global ICOM network are deeply shocked by the earthquake disaster in Syria and Turkey.

It is with great dismay that we see the inconceivable loss of life, the high number of injured and the damage to cultural sites as a result of the earthquakes in Turkey and Syria. As a National Committee in Germany with a large number of Turkish and Syrian citizens, colleagues and friends, we recognise that the impact of the earthquake disaster is directly intertwined with our country.

We express our sympathy to all those affected and assure them of our solidarity. We call on all museum colleagues inside and outside our association not to leave the affected colleagues and friends alone in this difficult situation.

As an organisation committed to the protection and preservation of cultural heritage, we are deeply saddened by the damage to several cultural sites, including the Aleppo Citadel in Syria and the Gaziantep Citadel in Turkey. We recognise their importance as essential components of the cultural identity and social fabric of the affected communities. Our sympathies are especially with the communities where important sites and the rich cultural history they represent have been damaged.

ICOM Germany understands the importance of protecting cultural heritage in times of crisis and we support efforts to protect and restore damaged sites in both countries. Given the challenges, we call on international organisations and governments to join forces and provide the necessary support to enable the long-term preservation and repair of cultural heritage in the affected regions.

Auf seiner Vorstandssitzung am 8. Februar 2023 hat der neue Vorstand von ICOM Deutschland einstimmig beschlossen, ICOM Russland zu bannen. Das deutsche Nationalkomitee fordert zudem, Vertreter:innen des russischen Nationalkomitees von allen internationalen Gremien zu suspendieren und keine russischen Delegationen oder Mitglieder mehr zu Veranstaltungen zuzulassen sowie ICOM Russland bis auf Weiteres aus dem Weltverband auszuschließen.

ICOM Deutschland boykottiert ab sofort das russische Nationalkomitee als nationalen Verband unter russischer Flagge. Das deutsche Nationalkomitee wird grundsätzlich weder mit ICOM Russland kooperieren noch an Veranstaltungen teilnehmen, bei denen Vertreter:innen von ICOM Russland oder russische Museumskolleg:innen anwesend sind.[1] ICOM Deutschland fordert zudem, dass das russische Nationalkomitee auch auf internationaler Ebene suspendiert wird. Dazu werden Gespräche mit weiteren ICOM Komitees und ICOM International intensiviert. Die Zielsetzung ist es, die Zusammenarbeit mit ICOM Russland komplett einzustellen sowie das russische Nationalkomitee bis auf Weiteres aus dem Weltverband auszuschließen.

Der Vorstand von ICOM Deutschland solidarisiert sich mit allen demokratischen, fortschrittlichen und liberalen Einrichtungen und Personen in Russland. Er ist sich bewusst, dass der Ausschluss auch Mitarbeitende in russischen Museen treffen wird, die sich für Frieden und Gerechtigkeit einsetzen. Der Kultursektor darf aber nicht dauerhaft eine Sonderrolle beanspruchen oder gar eine generelle Unschuldsanmutung für sich postulieren. Die systematischen Plünderungen ukrainischer Museen, die nach derzeitigem Kenntnisstand von russischen Museumsakteuren unterstützt werden und ein Beispiel für ethische Grenzüberschreitungen sind, sollten nicht länger unkommentiert bleiben. Die Berichterstattungen und Bilder aus ukrainischen Museen sprechen eine deutliche Sprache.

Der Vorstand von ICOM Deutschland bekräftigt weiterhin seine Solidarität mit den ICOM Mitgliedern in der Ukraine und allen Menschen, die von dem Krieg in der Ukraine betroffen sind und hofft auf ein schnelles und friedliches Ende dieser schrecklichen militärischen Invasion Russlands.

"Russlands Angriffskrieg gegen die Ukraine spottet dem Völkerrecht, der Haager Konvention und jeder gesellschaftlichen Grundnorm. Mit einem solchen Staat kann es keine normalen Beziehungen geben – auch nicht im Museumsbereich. Wir können nicht Plattform für die Russische Flagge sein und auch nicht gemeinsame Gäste unter einem Dach. Wir beziehen deutlich Position und handeln damit im Einklang mit der überwältigenden Mehrheit der Staaten, Verbände, Unternehmen und Organisationen weltweit. Auch Museen sind letztlich politische Akteur:innen und müssen sich positionieren. Es kann nicht weiter hingenommen werden, dass im Museumsbereich so getan wird, als wäre kein Krieg, als könnte ICOM Russland agieren, als wäre nichts geschehen.“, so der Vorstand von ICOM Deutschland.

ICOM Germany bans ICOM Russia

 

At its board meeting on February 8, 2023, the new board of ICOM Germany unanimously decided to ban ICOM Russia. The German National Committee is also calling for representatives of the Russian National Committee to be suspended from all international bodies and for Russian delegations or members to be no longer admitted to events, as well as to exclude ICOM Russia from the world association until further notice.

 

With immediate effect, ICOM Germany is boycotting the Russian National Committee as the national association under the Russian flag. In principle, the German National Committee will neither cooperate with ICOM Russia nor participate in events at which representatives of ICOM Russia or Russian museum colleagues are present.1 ICOM Germany is also demanding that the Russian National Committee be suspended at international level. To this end, talks with other ICOM committees and ICOM International are being intensified. The aim is to completely stop working with ICOM Russia and to exclude the Russian National Committee from the world association until further notice.

The board of ICOM Germany shows solidarity with all democratic, progressive and liberal institutions and people in Russia. It is aware that the exclusion will also affect employees in Russian museums who work for peace and justice. However, the cultural sector must not permanently claim a special role or postulate a general impression of innocence. The systematic looting of Ukrainian museums, which according to current knowledge is supported by Russian museum actors and is an example of ethical transgression, should no longer go uncommented. The reports and pictures from Ukrainian museums speak a clear language.

The Board of ICOM Germany continues to reaffirm its solidarity with the ICOM members in Ukraine and all people affected by the war in Ukraine and hopes for a quick and peaceful end to this horrific military invasion of Russia.

"Russia's war of aggression against Ukraine mocks international law, the Hague Convention and every basic social norm. There can be no normal relations with such a state - not even in the museum sec- tor. We cannot be a platform for the Russian flag and neither can we be common guests under one roof. We take a clear position and act in accordance with the overwhelming majority of states, associations, companies and organizations worldwide. Ultimately, museums are also political actors and have to position themselves. It can no longer be accepted that in the museum area it is pretended as if there was no war, as if ICOM Russia could act as if nothing had happened,” said the board of directors of ICOM Germany.

ІКОМ Німеччини бойкотує ІКОМ Росії

 

На засіданні правління 8 лютого 2023 року нова рада ICOM Німеччини одноголосно вирішила забойкотувaти ICOM Russia. Німецький національний комітет також закликає відсторонити представників Російського національного комітету від усіх міжнародних організацій і більше не допускати російських делегацій або членів на заходи, а також виключити ICOM Russia зі світової асоціації до подальшого повідомлення.

 

ICOM Німеччини негайно бойкотує Російський національний комітет як національну асоціацію під російським прапором. Німецький національний комітет не співпрацюватиме з ICOM Росії та не братиме участі в заходах, на яких присутні представники ICOM Росії або російські музейні колеги.1 ICOM Німеччини також вимагає призупинити діяльність російського національного комітету на міжнародному рівні. З цією метою активізуються переговори з іншими комітетами ICOM та ICOM International. Метою є повне припинення співпраці з ICOM Russia та виключення Російського національного комітету зі світової асоціації до подальшого розпорядження.

Правління ICOM Німеччини демонструє солідарність з усіма демократичними, прогресивними та ліберальними інституціями та людьми в Росії. Він усвідомлює, що виключення також торкнеться співробітників російських музеїв, які працюють за мир і справедливість. Однак культурний сектор не повинен постійно претендувати на особливу роль або постулювати загальне враження невинності. Систематичне пограбування українських музеїв, яке, згідно з сучасними відомостями, підтримується російськими музейниками та є прикладом етичного порушення, більше не повинно залишатися без коментарів. Репортажі та світлини з українських музеїв говорять зрозумілою мовою.

Правління ICOM Німеччини продовжує підтверджувати свою солідарність з членами ICOM в Україні та всіма людьми, які постраждали від війни в Україні, і сподівається на швидке та мирне припинення цього жахливого військового вторгнення Росії.

"Загарбницька війна Росії проти України знущається над міжнародним правом, Гаазькою конвенцією та кожною базовою суспільною нормою. З такою державою не може бути нормальних стосунків – навіть у музейній сфері. Ми не можемо бути трибуною для російського прапора і не можемо бути гостями під одним дахом. Ми займаємо чітку позицію та діємо відповідно до переважної більшості держав, асоціацій, компаній та організацій у всьому світі. Зрештою, музеї також є політичними акторами і повинні позиціонувати себе. Більше не можна погоджуватися з тим, що у зоні музею робиться вигляд, ніби війни не було, нібито ICOM Russia може діяти так, наче нічого не сталося», – заявила рада директорів ICOM Німеччини.

1. Sitzung des neuen Vorstands von ICOM Deutschland e.V. für die Amtsperiode 2023–2025

Am 4. November 2022 haben die Mitglieder von ICOM Deutschland e.V. auf ihrer Jahrestagung in Berlin eine Präsidentin und einen Vorstand für die Amtsperiode 2023–2025 gewählt. Die neu gewählte Präsidentin des deutschen Nationalkomitees, Dr. Felicia Sternfeld (Europäisches Hansemuseum Lübeck), setzt sich nun seit dem 01. Januar 2023 gemeinsam mit den Vorstandsmitgliedern Prof. Dr. Joachim Baur (TU Dortmund / Die Exponauten), Dominik Busch (Staatliche Kunsthalle Baden-Baden), Dr. Claudia Emmert (Zeppelin Museum Friedrichshafen), Dr. Alina Gromova (Stiftung Neue Synagoge Berlin - Centrum Judaicum), Suy Lan Hopmann (Behörde für Kultur und Medien Hamburg) und Dr. Gülşah Stapel (Stiftung Berliner Mauer) für eine diversere Vorstandsarbeit ein.

Am 14. Januar 2023 fand die konstituierende Sitzung des neuen Vorstands in Berlin statt. Hier wurde Dr. Alina Gromova (Stiftung Neue Synagoge Berlin - Centrum Judaicum) einstimmig zur Vizepräsidentin gewählt. Weitere Themenbereiche wurden in einer intensiven Sitzung diskutiert, welche die Vorstandsmitglieder einhellig als hervorragende Basis einer konstruktiven zukünftigen Zusammenarbeit bezeichneten.

Einig ist sich der Vorstand in dem Bestreben, zukünftig neue Akzente in der Einbindung der Mitglieder setzen zu wollen. Unter anderem sollen hierzu bestehende Formate (wie die „lunch breaks“) fortgeführt und um neue ergänzt, die internationale Zusammenarbeit durch Kooperationen gestärkt werden.

Zur Analyse bestehender Strukturen und Entwicklung einer neuen inhaltlichen Strategie wird der Vorstand Mitte Februar in München tagen.

Statement: Kandinsky Sale – Grisebach auction house

ICOM Germany and ICOM Poland wish to jointly express their support for the National Museum in Warsaw to take appropriate legal action to ensure the return of the stolen watercolour, Untitled (1928) by Wassily Kandinsky, recently listed by Grisebach auction house in Berlin. As the principal international body for museum standards and principles of conduct for the museum profession world-wide, ICOM takes matters related to the illegal trafficking and acquisition of stolen artworks very seriously.

History of the stolen Kandinsky
The watercolour was acquired by the National Museum in Warsaw in 1982, and exhibited at the museum in 1984 in the show Concepts of Space in Contemporary Art, during which it was stolen. It first resurfaced at a sale at Sotheby’s, London on 5 December 1984 , and in 1985 the International Foundation for Art Research (IFAR) published notice of the theft in the column "Stolen Art Alert". Despite the fact that the IFAR publication is widely circulated and consulted by art market actors, the work was sold again, at Galerie Thomas, Munich, in 1988.

Its recent listing in the sale catalogue of Grisebach auction house in Berlin prompted Poland's Ministry of Culture to send a request to Warsaw police to register the artwork in Interpol's stolen artworks database and provide detailed provenance documentation to the auction house. Officials from the ministry and the Polish embassy in Berlin thus requested that Grisebach withdraw the artwork from the 1 December sale due to its disputed provenance. The auction house maintained that the work was sold and bought in good faith.

However, ICOM Germany and ICOM Poland wish to highlight the following points:

1. The work has been published in several publications, including catalogues and the IFAR column. The catalogues were accessible and had the auction houses involved in the circulation of the stolen artwork executed proper due diligence, these red flags would have been revealed.
2. The reverse of the painting bears the property stamp of the National Museum in Warsaw, suggesting that the museum should have been consulted by each auction house before any sale took place to verify its provenance.

United Nations Resolution 76/16
On 6 December 2021 the United Nations adopted a resolution on the Return or restitution of cultural property to the countries of origin, of which Recital 33 is of particular relevance to this case, whereby it invites:


[…] those who deal with trade in cultural property and their associations, where they exist, to encourage the effective implementation of the International Code of Ethics for Dealers in Cultural Property, as endorsed by the General Conference of the United Nations Educational, Scientific and Cultural Organization on 16 November 1999, the International Council of Museums Code of Ethics for Museums and other existing codes.


As stated, the Resolution invites art market actors to conduct their business in the spirit of the ICOM Code of Ethics for Museums, of which the Recitals on Valid Title (2.2) and Provenance and Due Diligence (2.3) are particularly relevant to this case, for they underscore the importance of the documentary establishment of valid title. These very provisions are also reflected in Article 1 of the International Code of Ethics for Dealers in Cultural Property, which states that “Professional traders in cultural property will not import, export or transfer the ownership of this property when they have reasonable cause to believe it has been stolen [or] illegally alienated […].”

It is clear that an indisputable right to ownership of property on behalf of the consignor is not evident in this case. While ICOM Germany and ICOM Poland note the fact that the auction house has halted further handling of the sale and has sought a court review, it is maintained that the sale should be considered invalid and that the work should be returned to the legal owner on the basis of a mutual agreement between all parties.

Further implications
This case also evokes a more general reconsideration of the circulation of cultural objects within the art market. Due diligence research should be systematically and rigorously conducted by all art market intermediaries. In this case, a simple call to the museum by one of the intermediaries would have resolved the issue immediately (as the painting still bears the museum’s stamp). On the basis of the present case, therefore, ICOM Germany and ICOM Poland wish to appeal for a radical procedural change within the art market in order to prevent future instances of this problem and ensure the legal circulation of cultural objects.

Stellungnahme: Angriffe auf Kunstwerke in Museen

Aus aktuellem Anlass veröffentlichen die unterzeichnenden Institutionen folgende Stellungnahme:

Statement
In recent weeks, there have been several attacks on works of art in international museum collections. The activists responsible for them severely underestimate the fragility of these irreplaceable objects, which must be preserved as part of our world cultural heritage. As museum directors entrusted with the care of these works, we have been deeply shaken by their risky endangerment. 

Museums are places where people from a wide variety of backgrounds can engage in dialogue and which therefore enable social discourse. In this sense, the core tasks of the museum as an institution – collecting, researching, sharing and preserving – are now more relevant than ever. We will continue to advocate for direct access to our cultural heritage. And we will maintain the museum as a free space for social communication.

Stellungnahme
In den vergangenen Wochen gab es mehrere Angriffe auf Kunstwerke in internationalen Museen. Die dafür verantwortlichen Aktivisten unterschätzen die Fragilität dieser unersetzlichen Arbeiten, die es als Weltkulturerbe zu bewahren gilt. Als Museumsdirektorinnen und -direktoren, denen die Werke anvertraut sind, hat uns ihre riskante Gefährdung zutiefst erschüttert.

Museen sind Orte, an denen Menschen unterschiedlichster Hintergründe in einen Dialog treten können und die gesellschaftliche Diskurse ermöglichen. In diesem Sinn sind die Kernaufgaben der Institution Museum – Sammeln, Forschen, Vermitteln und Bewahren – heute relevanter denn je. Wir setzen uns weiter für den unmittelbaren Zugang zu kulturellem Erbe ein. Wir werden Museen als Freiräume gesellschaftlicher Verständigung erhalten.

Ces dernières semaines, plusieurs attaques ont été perpétrées sur des œuvres d’art conservées dans les collections de musées de renom international. Les activistes responsables de ces attaques sous-estiment largement la fragilité de ces œuvres irremplaçables qui doivent être préservées car faisant partie intégrante de notre patrimoine culturel mondial. En tant que directrices et directeurs de musées en charge de la conservation de ces œuvres, nous sommes profondément choqués par leur mise en danger inconsidérée.

Les musées sont des lieux où s’établit un dialogue entre des personnes d’horizons très divers et donc des lieux qui contribuent aux échanges sociétaux. De ce fait, les fonctions essentielles du musée – collection, recherche, médiation et conservation – sont plus essentielles et plus pertinentes que jamais. Nous continuerons à nous engager pour offrir à tous un accès direct à notre patrimoine culturel. Nous allons aussi veiller à ce que le musée demeure un espace de liberté pour la communication et l’entente mutuelle.

En las ultimas semanas hubo varias agresiones a obras de arte en museos internacionales. Los activistas responsables subestiman la fragilidad de estas irreemplazables obras de patrimonio cultural mundial, que deben ser conservadas. Como directoras y directores de museos responsables de las obras, su peligrosidad nos ha conmovido profundamente.

Los museos son lugares en los cuales las personas con diferentes fundamentos pueden entrar en un diálogo y con ello hacen posible el discurso social. En este sentido, las tareas centrales del museo como institución (coleccionar, investigar, compartir y preservar) son ahora más relevantes que nunca. Continuamos ocupandonos de inmediato  al acceso hacia la herencia cultural y mantendremos el museo como un espacio libre para comunicación social.
